Overview of LLCs and Corporations
Main Uses: Traditional business entity planning, with limited liability for the shareholders or members being one of the most important considerations. Do not get involved, or try to get NAFEP involved in any in-depth entity usage, function or entity taxation planning. Have the client see his/her own tax and or legal counsel for those issues. NAFEP's role in creating corporations and LLCs is limited to: Providing educational information and creating the entity. The entity function, use and tax planning must be left to the client and the client's tax and/or legal counsel. The NAFEP corporation & LLC application form discloses NAFEP's limited role to the client.
Overview of Premier I, Living Trust
Main Uses: General family estate planning. A Premier I (or a Premier II Life Estate Trust) should be the foundation for virtually all estate plans, regardless of the client's wealth.
Overview of Premier II, and Premier LitE Life Estate Trust
Main Uses: General family estate planning with a special emphasis on asset protection. A Premier II (or a Premier I Living Trust) should be the foundation for virtually all estate plans, regardless of the client's wealth. Do not sell this to a client unless asset protection is one of their specific and primary goals, but all clients worth more than approximately $100,000 (net worth) should be exposed to this program. See Special Note 4 below on Medicaid. See the following "Setup and Operating Guide" for the differences between a Premier II and Premier LitE, and for a thorough discussion on this program.
Overview of Premier III, Children's/Gifting Trust
Main Uses: Annual gifting by grantors to create an education or other special fund for children, grandchildren, etc. For the reduction of a taxable estate, using annual gift tax exemptions to make the gifts. Sometimes used to make a single and large gift, such as a family farm, which is to be held in trust until the death of the grantors or some other future event. Sometimes is used as a "special needs" trust, to provide life time care for a disabled or handicapped beneficiary. Can be used to hold awards from lawsuits, for the benefit of a minor or handicapped beneficiary.
The annual gifts, using annual gift tax exclusions, require the trust to have a "crummey provision" (see the following Setup and Operating memo). The single large gifts do not require a crummey provision, but do require the use of the grantor's life time gift tax exemption.
